Arrangements for prisoner release underway

After the cabinet approved on Sunday the decision to release 104 Palestinian prisoners as a gesture to Palestinian President Mahmoud Abbas ahead of the resumption of peace negotiations, it was reported Monday that the Israeli judicial system and the Justice Ministry have already set working orders in place with regards to the prisoners’ release, based on similar releases in the past, diplomatic attempts and peace talks between Israel and the Palestinians.

The cabinet approved Sunday the release of 104 security prisoners with a majority of 13 ministers voting in favor, and seven ministers opposing the decision. Minister Limor Livnat and Silvan Shalom abstained.

According to the resolution, 104 prisoners will be released and a ministerial committee to be headed by Netanyahu and ministers Ya’alon, Livni, Aharonovitch and Perry will be established to supervise the process as part of the negotiations with the Palestinians. In addition, if it would be decided to release Arab-Israeli prisoners, the matter will be brought for reapproval of the cabinet.

Minister Naftali Bennett addressed the decision saying: “It if a difficult day for the entire government and the decision has been made.”

Earlier Thursday, Justice Minister Tzipi Livni said regarding the release: “This meeting is one of the most important ones to the future of Israel. The decision involves great grief, but needs to be made.”

Livni added: “In the past, Israel released prisoners with a gun to her head and handed them at the terrorist organizations’ request. Today it’s not the case, we release vile murderers who rightfully spent years in the Israeli prison, and they will only be released if the negotiations prove serious.”

Shin Bet Director Yoram Cohen expressed reservation regarding the release of 104 security prisoners, stating that “their release will damage security, both in terms of immediate threat to public safety and in terms of an erosion of deterrence.”

Nonetheless, Cohen noted that resuming peace talks with the Palestinians will have a positive effect in “calming Judea and Samaria, especially in regards to activists affiliated with the Palestinian Authority, such as the Tanzim group.”

The Shin Bet chief handed the government a list of prisoners divided into three categories: Prisoners the Shin Bet believes can be released, prisoners who should not be released and prisoners who should be released to Gaza or deported.

The list was divided in accordance with the level of threat each prisoner poses to public safety, in the eyes of the intelligence organization.

Cohen also submitted recommendations to minimize risks pertaining to prisoners who are released.

The Shin Bet was updated on the issue of prisoners’ release last week, and after reviewing their profiles determined that all were murderers “with blood on their hands” from various organizations and regions. The organization thus fears they might commit additional crimes.

The Shin Bet noted that the organization was not required to inform the cabinet whether it supported or opposed the decision, but was rather only asked to review the manner in which the decision is to be implemented.

After the cabinet approved on Sunday the decision to release 104 Palestinian prisoners as a gesture to Palestinian President Mahmoud Abbas ahead of the resumption of peace negotiations, it was reported Monday that the Israeli judicial system and the Justice Ministry have already set working orders in place with regards to the prisoners’ release, based on similar releases in the past, diplomatic attempts and peace talks between Israel and the Palestinians.

The Justice Ministry Pardons Department began preparing documents and permits to release Palestinian prisoners even before the cabinet approved the process as part of the renewal of negotiations.

Generally, the Justice Ministry has a database of over 5,000 prisoners categorized by different criteria, including age, crime, level of security risk, and sentence length. The database allows the cabinet to compile an organized list of prisoners to be released in conjunction with security services.

However, since specific prisoners were named during the preliminary round of peace talks mediated by US Secretary of State John Kerry, this process will not be necessary. The Justice Ministry still must determine the location to which the prisoners will be taken: The West Bank, Gaza, or destinations abroad.

Following preliminary work and approval of Justice Minister Tzipi Livni, the list of prisoners will be submitted to Israeli President Shimon Peres, who will officially sign the sentence reductions. The names of the prisoners will be released openly in order to allow the public to submit appeals to the Supreme Court.

The Israeli Prison Service (IPS) is also preparing for the prisoners’ release. During each of the planned rounds of releases, IPS staff will receive prisoner names from the Justice Ministry, and assume preparations. The prisoners will undergo identification, medical examinations, and will be required to report to the commander of the prison in which they are serving their punishment. Additionally, they may be required to sign a statement declaring they will not engage in any terrorist activity in the future.

Prisoners are commonly transferred to one prison in anticipation of their release. Once the government officially sanctions the operation, army units will escort the prisoners to their release checkpoint under thick security.

The prisoners, who are serving sentences for terrorist activities committed before 1993, have been informed by the media of the intent to release them. However, they are currently keeping a low profile and focusing on the Ramadan fast.
