8.1 In the event of disputes between the landlord and the tenant that cannot be resolved through discussions between the parties, the matter is referred to an arbitrator appointed by the President at the time of the Institute of Arbitrators and Ombudsman of New Zealand. Such an arbitration procedure must be carried out in accordance with the provisions of the 1996 Arbitration Act and all decisions are final and binding. Below is a template for the terms and conditions of sale that you can use as a guide. As all apartments are different, it is very likely that you will need to add other specific clauses to your individual property. This model is a starting point. We used sample values for things like the amount of the bond, the amount of the deposit and the maturity. You should adapt this model to your specific needs and needs of your property. Some owners provide the agreement somewhere on the site (usually on a separate page, accessible via a hyperlink) and claim that customers accept the terms of the agreement using the site. This is called the “Browsewrap” agreement. The latter often includes companies that rent housing and lease the property to their employees, usually under a licensing agreement (unlike a lease). As with any legal agreement, you should seek advice before using this legal advice.
1.2 Trade Me Limited manages the holidayhouses.co.nz website (the “website”) and is not a representative of the owner or party in this agreement. The terms and conditions of the site (presented on the site) apply to landlords and tenants who use the site. Any dispute between the landlord and the tenant is a matter between them and the parties to this agreement, not to take action against Trade Me Limited in a dispute between them. Finally, you should review your rules from time to time and make adjustments based on your experience as a holiday homeowner. This agreement is intended only for a Holiday Let. If the circumstances clearly show that the tenancy is NOT for the purpose of the lease holiday, for example because the time limit is so long, the courts may find that it is a short-term lease agreement (and you will not be able to obtain an order for possession of the property for at least six months from the beginning of the lease). A rental agreement is an agreement between an owner and a holidaymaker for a short-term rental of a holiday rental property. The owner can apply for a security deposit to cover the costs of possible breaches or damage to the property or its contents.
